General Disclosures

Personal Information. Business-to-Business. We provide our Services to businesses, and not to individual consumers. Therefore, most of the data that we collect is regarding businesses. However, while providing our Services, we may collect personal information of individuals, as will be described in this Policy. This may include personal information that we collect about you when you visit our sites or your business contact information if we provide our Services to a company that you work with or if you are a sole proprietorship and you engage with our Services.

Outside of the United States. Our Services are hosted in the United States. ‍If you are visiting the Services from outside of the United States, please note that by providing your information, it is being transferred to, stored or processed in the United States and other countries, where our data center and servers are located and operated. This policy sets forth our privacy commitment for the United States. You Provide Information to Us

We collect information about you when you interact with our Services, such as when you create or update an account in Polaris IQ™, subscribe to one of our newsletters, type text in the search bar on our website, or participate in one of our events.

  • Identity Information, which includes first name, middle initial, last name, date of birth, gender, username or similar identifier.
  • Contact Information, which includes personal mailing address, email address, telephone number.
  • Financial Information, which includes bank account information and payment card details.
  • Transaction Information, which includes details about the products and services you have purchased from us and the corresponding transactions.
  • Technical Information, which includes cookie information, location pixel, browsing time, website history, internet protocol (IP) address, your login data, time zone setting and location (geocodes), geolocation data, auth0 logs, pages visited, pages viewed, events and page loads, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access this website.
  • Profile Information, which includes your username and password and your preferences.
  • Usage Information, which includes information about how you use our website, products and services.
  • Marketing and Communications Information, which includes your preferences in receiving marketing from us and our third parties and your communication preferences.

Automatically Through Our Services

As you navigate through and interact with our Services, we may use automatic data collection technologies to collect information that may include personal information. Information collected automatically may include usage details, IP addresses, operating system, and browser type, and information collected through cookies, web beacons, and other tracking technologies including details of your interactions with our Services, such as traffic data, location data, logs, and other communication data, and which resources and Services features that you access and use.

We may receive personal information about you from other sources and combine that with information we collect directly from you. For example:

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

  • To third parties who help us with our marketing efforts, including social media platforms, advertising networks, and ad tech companies. For example, we may share email addresses or other information (see above chart) with social media platforms so they can serve our advertising to you on their platform.Personal information received by our partners may also be subject to their privacy policies.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Wpromote’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Wpromote is among the assets transferred.
  • To third parties to market their products or services to you if you have not opted out of these disclosures. We endeavor to require these third parties to use personal information only for the purposes for which we disclose it to them. Your Choices About Your Information. You have certain choices about how we use your information:

  • Cookies and Other Tracking Technologies. You can set your browser to refuse all or some browser cookies or other tracking technology files, or to alert you when these files are being sent. If you disable or refuse cookies or similar tracking files, some Services features may be inaccessible or not function properly.

    Some browsers include a “Do Not Track” (DNT) setting that can send a signal to the online services you visit indicating you do not wish to be tracked. Because there is not a common understanding of how to interpret the DNT signal, our Services may not respond to all browser DNT signals. Instead, you can use the range of other tools to control data collection and use, including the cookie controls and advertising controls described in this policy.   • Promotions by the Wpromote. If you do not wish us to use your information to promote our own or third parties’ products or services, you can opt out by sending us an email stating your request to privacy_request@wpromote.com or following the unsubscribe link in the applicable email.
  • Disclosure of Your Information for Third-Party Advertising. If you do not want us to share your personal information with unaffiliated or non-agent third parties for advertising and marketing purposes, you can opt out by sending us an email stating your request to privacy_request@wpromote.com. We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt-out of targeted advertising from certain providers that participate in the Digital Advertising Alliance (DAA) program at www.aboutads.info/consumers. Other providers are members of the Network Advertising Initiative, and you can opt-out of interest-based advertising by those members by visiting http://optout.networkadvertising.org/. Please note that by opting out, you will continue to see generic advertising that is not tailored to your specific interests and activities. To be clear, cookie-based opt-outs must be performed on each device and browser that you wish to have opted-out. For example, if you have opted out on your device browser, that opt-out will not be effective on your mobile device. You must separately opt out on each device.

California and Additional State Privacy Rights

If you are a California resident, the CCPA grants you the following rights regarding your personal information:

  • Right to Know and Data Portability Requests. You have the right to request that we disclose certain information to you about our collection and use of your personal information (the “right to know”), including the specific pieces of personal information we have collected about you (a “data portability request”). Our response will cover the 12-month period preceding the request, unless doing so would be impossible or involves disproportionate effort. You may make exercise your right to know twice within in any 12-month period. Once we receive your request and confirm your identity, we will disclose to you:
    • The categories of personal information we collected about you; and the sources from which we collected your personal information.
    • The business or commercial purpose for collecting your personal information and, if applicable, selling or sharing your personal information.
    • If applicable, the categories of persons, including third parties, to whom we disclosed your personal information, including separate disclosures identifying the categories of your personal information that we disclosed for a business purpose to each category of persons; and sold or shared to each category of third parties.

When your right to know submission includes a data portability request, a copy of your personal information subject to any permitted redactions.

  • Right to Delete and Right to Correct. You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions and limitations (the “right to delete”). Once we receive your request and confirm your identity, we will delete your personal information from our systems unless an exception allows us to retain it. We will also notify our service providers, contractors, and other recipients to take appropriate action. You also have the right to request correction of personal information we maintain about you that you believe is inaccurate (the “right to correct”). We may require you to provide documentation, if needed, to confirm your identity and support your claim that the information is inaccurate. Unless an exception applies, we will correct personal information that our review determines is inaccurate and notify our service providers, contractors, and other recipients to take appropriate action.
  • Right to Limit Sensitive Personal Information Use. You have a right to ask businesses (as that term is used under the CCPA) that use or disclose your sensitive personal information to limit those actions to just the permitted purposes allowed under the CCPA (the “right to limit”). As we do not use or disclose sensitive personal information beyond the CCPA’s permitted purposes, we do not currently provide this consumer right.
  • Sale/Share Opt-Out Rights. You have the right to request that we stop selling or sharing your personal information at any time (the “right to opt-out”), including through a user-enabled opt-out preference signal. We cannot sell or share your personal information after we receive your request to opt-out unless you later consent to the sale or sharing of your personal information.
  • Right to Nondiscrimination. You have the right not to be discriminated or retaliated against for exercising any of your privacy rights under the CCPA.

Important: Depending on your U.S. state of residence, you may have rights similar (or other rights) to the rights available to California resident. The exact scope of these rights varies by state and may be subject to exceptions where we may not have an obligation to fulfill your request.   • Only you, or someone legally authorized to act on your behalf, may make a request to know, delete, or correct related to your personal information. To designate an authorized agent, please submit signed written permission stating that the designated agent is authorized to exercise the applicable rights on your behalf. We may request specific information from you or your authorized representative to confirm your or their identity before we can process your right to know, delete, or correct your personal information. We cannot respond to your request to know, delete, or correct if we cannot verify your identity or authority to make the request and confirm the personal information relating to you.   • Opt-out preference signals provide consumers with a simple and easy-to-use method by which to exercise the right to opt-out of the selling and sharing of their information. Global Privacy Controls (GPC) is a user-enabled opt-out preference signal which can communicate a user’s “Do Not Sell or Share” request on behalf of the person or device. We will process opt-out preferences from GPC signals which are in formats commonly used and recognized by businesses, such as an HTTP field header. We will treat a consumer’s use of GPCs as a valid request to opt-out of the selling and sharing of information for that browser. We currently do not connect browser use to particular consumers and, as such, you will need to use GPCs on all browsers in which you access our website and use our opt-out form to opt-out of offline sales.
  • Do Not Track (DNT) is a privacy preference that users can set if they do not want web services to collect information about their online activity. We do not respond to DNT signals or other mechanisms (with the exception of GPCs) that provide a choice regarding the collection of personal information about activities over time and across different websites or online services. We encourage users who have DNTs to use GPCs.

Responding to Your Requests.

  • Requests to Know, Delete, or Correct. We will confirm receipt of your request within ten business days. If you do not receive confirmation within the ten-day timeframe, please contact privacy_request@wpromote.com. We endeavor to substantively respond to a verifiable request within 45 days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing. We will deliver our written response to your verified email address. Our substantive response will tell you whether we have complied with your request. If we cannot comply with your request in whole or in part, we will explain the reason, subject to any legal or regulatory restrictions. Applicable law may allow or require us to refuse to provide you with access to some or all personal information that we hold about you, or we may have destroyed, deleted, or made your personal information anonymous in compliance with our record retention policies and obligations. Any disclosures we provide will cover information for the 12-month period preceding the request’s receipt date. We will consider requests to provide a longer disclosure period that do not extend past January 1, 2022, unless providing the longer timeframe would be impossible or involves disproportionate effort. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance, specifically a comma-separated values (.csv) format. We do not charge a fee to process or respond to your verifiable request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
  • Request to Opt-Out. In response to your request to opt-out, we will process your request, as soon as feasibly possible, but no later than 15 business days from the date we receive the request. You do not need to create an account with us to exercise your opt-out right. We will only use personal information provided from your request to comply with the request. We will also notify our service providers, contractors, and certain other downstream recipients of your request to opt-out and instruct them to both comply with the request and forward the request to their own downstream recipients, if applicable. We may deny opt-out requests if we have a good-faith, reasonable, and documented belief that the request is fraudulent and will clearly explain our denial decision to the requestor. Once you make a request to opt-out, we will wait at least 12 months before asking you to reauthorize personal information sales or sharing. However, you may change your mind and opt back in at any time through the means for doing so provided in the Services.

Appeal Rights. In the event we refuse to act in response to your request, we will provide you with information regarding our appeal process. We will inform you in writing of any action taken or not taken in response to an appeal within a reasonable time after receipt of your appeal, including our written explanation of the reason or reasons for our decision. If we deny your appeal, we will provide you with information regarding the online mechanism by which you may contact your State Attorney General to submit a complaint.

How We Protect Your Personal information. We use commercially reasonable administrative, physical, and technical measures designed to protect your personal information from accidental loss or destruction and from unauthorized access, use, alteration, and disclosure. However, no website, mobile application, system, electronic storage, or online service is completely secure, and we cannot guarantee the security of your personal information transmitted to, through, using, or in connection with the Services. In particular, email, texts, and chats sent to or from the Services may not be secure, and you should carefully decide what information you send to us via such communications channels. Any transmission of personal information is at your own risk.

The safety and security of your information also depends on you. You are responsible for taking steps to protect your personal information against unauthorized use, disclosure, and access.

How We Retain Your Personal information. We keep the categories of personal information described in this policy for as long as reasonably necessary to fulfill the purposes described or for as otherwise legally permitted or required, such as maintaining the Services, operating our organization, complying with our legal obligations, resolving disputes, and for safety, security, and fraud prevention. This means that we consider our legal and business obligations, potential risks of harm, and nature of the information when deciding how long to retain personal information. At the end of the retention period, personal information will be deleted, destroyed, or deidentified.

In some circumstances we may anonymize or de-identify your personal information (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you. This allows the specific information collected (name, email, address, phone number, etc.) to become anonymous but allows us to keep the non-personal information. For example, we will not be able to tell if John Smith registered for an event, but we will be able to tell that a person registered for an event and maintain headcount and transactional history. This will allow us to maintain a level of information that helps us develop and improve our Services.

Changes to Our Privacy Policy. We may update this policy from time to time, and we will provide notice of any such changes to the policy as required by law. The date the privacy policy was last updated is identified at the top of the page. We will notify you of changes to this policy by updating the “last updated” date and posting the updated policy on the Services. We may email or otherwise communicate reminders about this policy, but you should check our Services periodically to see the current policy and any changes we have made to it.
